Data Protection Introduction

This data protection declaration has been written with the intention of informing you about how I process personal data. The protection of your privacy is of the utmost importance to me. For this reason, I happily comply with all relevant legal requirements in regards to data privacy.

Who is it that you are doing business with?

The company covered under this policy, who may be collecting your personal data is Apridian, L.L.C, which uses this domain: https:www.apridian.com. (hereby, “Apridian LLC”)

Apridian LLC is contained within the jurisdiction of the United States of America and is therefore not required to follow any of the rules presented in the GDPR. Likewise, Apridian LLC’s state jurisdiction belongs to North Carolina, which does not currently issue any additional privacy rules to follow. For customers coming from areas such as Europe and California, who do have stricter data policies, I want to put your mind at ease in that even though I am not required to follow these stricter policies, I will do my best to inform you of: what data I collect, how I use and handle that data, and what you can do if you ever wish to revoke usage of your data.

April Klein, the owner of this website, claims legal responsibility - to the extent which is necessary for Limited Liability Companies - for the processing of user data in direct correlation with this website (apridian.com). This responsibility gives her the right to make important decisions about which user data is collected, saved, and in select cases - shared. All of these decisions will be made transparent within this data policy. She may decide to make decisions regarding this data, including any legally required actions, alone or with help of other qualified professionals.

Objection to advertising e-mails & misuse of contact & personal data:

I clearly state my objection for visitors, including non-human visitors, such as bots and website crawlers (i.e. the programmers held responsible), to use the contact data published within the framework of this website (including references that are only seen in code) for illegal purposes. This, of course, also includes the published contact data found within my website's information webpages. It is unlawful to use my personal and business data for the intent of sending me unsolicited advertising and informational materials.

What personal data do I collect and why do I collect it?

In the general sense, I will not, under any circumstance, personally sell, give away, or in any way transfer your private information to other third-parties without your explicit consent. Regardless of the previous statement, you should be aware that, by choosing to do business with me, you agree to allow me to send some of your data to the select providers that I use to run my business. It is because of this type of data transfer that this policy largely exists.

I use built-in third-parties on my website and as other forms of software to increase my productivity and to enhance the quality of my service to you. I collect personal information with the intention of providing you with better service and I will only use this information for my own business purposes. In the event that I need very specific or additional information, I will always inform you of what I intend to use the data for.

Because I update this website myself, I may choose to include companies and services within my privacy policy that I do not yet use (example: references to advertising) or that I may not use to the extent that it is mentioned in this policy. When visitors leave comments on this site I collect the data shown within the comments form (things like user name, user avatar, and posted text). I also collect the visitor’s IP address and browser user agent string to help with spam detection.

An anonymized string created from your e-mail address (also called a hash) may be provided to the Gravatar service to see if you are using it.

Media:

If you upload images to this website, you should avoid uploading images with embedded location data (example file formats: EXIF, GPS). Visitors can download and extract any location data found within image metadata. (Note that your phone's camera may automatically be set to store location data.)

The protection of children's data is very important, especially in the online arena. The website is not designed for children, and it is not aimed at them. I will also add that I am a fantasy artist and that by nature, some images may be too violently graphic, nude, or otherwise inappropriate for children's eyes. For this reason, I suggest that parents do not allow their children access to my website without supervision.

How long I Retain Your Data:

If you leave a comment, the comment and its metadata are retained indefinitely. This is so that I can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on this website (if any), I also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (for the exception of their username). Website administrators (currently just me) can also see and edit this information.

For other personal data types, I keep your data up until you explicitly request a deletion of your data.

How I protect Your Data:

I keep very little personal customer data locally on my computer. If I should choose to store it there, it will be encrypted and password encrypted.

My primary goal is to provide you with artistic services. This means that realistically, I need to use third parties to help me manage your data (things like email servers, billing software and payment services, such as PayPal) in a secure and efficient way. In this regard, I typically use big name brands to do business with and I continually seek out only to do business with trustworthy companies. However, since I am reliant on these other companies as well, Apridian LLC cannot be held accountable for any data leakage or misuse related to or caused by these partner companies in relation to services provided by my company.

As far as your images are concerned, I am also doing my part to ensure that your files are properly saved and backed-up regularly and that they are being transferred safely and securely to you. Apridian LLC cannot be held responsible in the event that a data transfer service (such as WeTransfer, Dropbox, Microsoft One Drive, or Google Drive, etc.) leaks or misuses your (licensed) data. Unfortunately, we all run risks when we trust these and other cloud services.

If at any point I become aware of the leakage or misuse of personal data I will inform my customer(s) immediately.

The web host is used for the purpose of fulfilling contracts with potential and existing customers. This professional provider is also used with the intent and interest of providing a safe, fast, and efficient interface for my online offers.

TLS Encryption with HTTPS

I use https to transmit data securely on the Internet (data protection through technology design. By using TLS (Transport Layer Security), an encryption protocol for secure data transmission over the Internet, I can ensure the protection of confidential data. You can recognize the use of this data transfer protection by the small lock symbol in the top left of the browser and the use of the https scheme (instead of http) as part of this internet address.

Server Log Files

The provider of this website automatically collects and stores information in so-called server log files. (Your browser automatically transmits this data to my website.)

This website is hosted in the United States and is targeted at customers living within the United States. It is not an international website. For this reason, I have opted not to include a GDPR cookie-banner (which allows the customer to control whether or not they allow non-essential browser cookies.) at this time, as I personally find them incredibly annoying when browsing. If a website user has a problem with this, then they should not use this website.

General Contact Policy

Requests by e-mail, phone and all other contact methods

If you contact me by e-mail, phone, (or for example by a fax equivalent or through social media chats, etc.), then your request / correspondence, including all personal data resulting from it (ex. name and inquiry), will be stored and processed for the purpose of processing your request. I will not pass this data on without your consent.

The data that you send to me via contact requests will remain with me until you request deletion, revoke your consent to the storage, or until the purpose for data storage no longer applies (ex. after your request has been processed). Mandatory legal provisions, especially retention periods, remain unaffected.

Contact Forms

If you send me inquiries by using a contact form, your details from the inquiry form, including the contact data that you provide there, will be stored for the purpose of processing the inquiry. These details enable me to send follow-up e-mails to address business-related questions and discussions with existing and potential customers. I will not pass this data on without your explicit consent. (However, third-parties involved in my mailing process may have limited access to this data.)

How long is the data stored?

The data that you enter in the contact form will remain with me until you request deletion or revoke your consent to storage. The data may also be deleted if the purpose for data storage no longer applies (ex. after your request has been processed). However, mandatory legal provisions, especially retention periods, remain unaffected.

Confidential Mail Notification:

If you send me personal data by e-mail, for example - by using forms on this website - you should be aware that this transferring of data exists outside of this website's hosting framework. Therefore, I cannot guarantee secure transmission and protection of your data. For this reason, I recommend that you never send unencrypted confidential data by e-mail.

Newsletter Subscription

When you sign up for my newsletter, you submit personal data in an online form. You will be required to enter your name and e-mail address. No further data is collected, or if for any reason it is, then these extra details are only given on a voluntary basis. After verifying your e-mail (opting-in), you give me the right to contact you by e-mail. I use the data saved along with your registration exclusively for the newsletter and I do not pass it on to any third-party companies (for the exception of those involved in my newsletter sending process).

Legal Basis

The processing of the data entered in the newsletter registration form takes place exclusively on the basis of your consent. You can revoke your consent to the storage of the data, the e-mail address, and its use for sending the newsletter, at any time.

Stored Data

The data stored for the purpose of subscribing to the newsletter will be stored by this website or the newsletter service provider until you unsubscribe from the newsletter - this means until after you are deleted from the newsletter distribution list. This happens automatically after you unsubscribe from the newsletter. Data that I have stored for other purposes remain unaffected.

How to Unsubscribe

If you unsubscribe from the newsletter - you will find the link for this at the bottom of every newsletter - then I will delete the data that was saved when you first subscribed to the newsletter, including your name and e-mail address. The legality of the data processing that has already taken place remains unaffected by the revocation.

After you have unsubscribed from the newsletter distribution list, your e-mail address may be saved in a "blacklist", either on this website or in correlation with the newsletter service provider, to prevent future mailings. The data contained within the blacklist is only used for this purpose, and it is not combined with any other data.

This serves both your interest and my interest in compliance with the legal requirements regarding the sending of newsletters (a legitimate interest is qualified by the definition found in GDPR: Article 6 Para. 1f). There is no time limit assigned for the saving of data within a blacklist, therefore you can assume that such data is stored indefinitely. You can object to this storage only if your interests outweigh my legitimate interests.
